HIBERNOT CHALLENGE TERMS AND CONDITIONS

INTRODUCTION Land Rover (“Sponsor”) is sponsoring and BritMums of Chiltern House, 45 Station Road, Henley-On-Thames, RG9 1AT (“Administrator”) is administrating the #Hibernot Daily Photo Challenge (“Challenge”), as described in these Terms and Conditions.
ACKNOWLEDGEMENT This Challenge is no way sponsored, endorsed, administered or associated with Instagram.
ELIGIBILITY The Challenge is open to legal residents of the United Kingdom who are at least 18 years of age at time of entry (“Participants”). No purchase is necessary. Directors, officers, management, employees, other staff, agents, distributors and wholesale customers of Sponsor and Administrator and family members thereof or any of its affiliated companies or any other persons involved in the making of this Challenge are not eligible to enter this Challenge. Any entry not complying with these Terms and Conditions is invalid. Sponsor explicitly reserves the right to refuse or remove a submission of an entrant, at its sole discretion, in the event Sponsor determines an entrant does not comply with all rules and regulations as contained herein. It is not the responsibility of Sponsor to ensure that the Challenge entry and/or submission requirements and use of personal information do not contravene the laws and regulations of any country from which the entry and/or submission is being submitted, where it is being received or viewed. For the aforementioned reason, all responsibilities relating to the entries and/or submissions to the Challenge will be borne by the Participants who, it is understood, have submitted such entries and/or submissions under their own responsibility and risk. In the event that any misfortune or damage should be experienced on the side of the Participant(s), Sponsor will not be responsible.
TIMING The Challenge commences at 12:00 AM GMT on Thursday January 8, 2015 and ends at 23:59 GMT on Saturday January 17, 2015 (“Entry Period”). Challenge may be delayed or cancelled based on Instagram availability.
HOW TO ENTER Entrants must have a mobile device that supports the Instagram application, have the Instagram application downloaded on their device, and have a valid Instagram account. To enter Entrants must: (a) log onto their Instagram account; (b) on Instagram follow Administrator’s Instagram feed @BritMums and Sponsor’s Instagram feed @LandRover or @LandRoverUK; (c) upload an original digital photo taken created and taken by entrant for the theme to Instagram and tag using the #Hibernot hashtag and (d) fill out the entry form (bit.ly/hibernot) to receive one (1) entry into Challenge. Entrants may enter multiple times per day or throughout the Challenge time period by submitting a separate image each time, adhering to the guidelines in How To Enter with each entry. Entrants should be considerate and feature people who are willing models and participants in their images. Inclusion of people, including minors, will be assumed to be with their consent and the consent of their parent or guardian. Message and data rates may apply. Entrants can open an Instagram account for free by registering with instagram.com or download the Instagram app via iTunes or Google Play. Entrant must be in compliance with the Instagram Terms of Use and Instagram Privacy Policy. All entries must be complete and received before the end of the Entry Period to be eligible for the prize drawings; Entries may only be submitted by a single registered Instagram user, group submissions are not permissible. Multiple entrants are not permitted to share the same device or e-mail address. Use of computer programs and/or other automated devices to enter the Challenge is prohibited. Normal Internet access and Device usage charges imposed by your on-line service will apply.
ENTRY REQUIREMENTS By entering into this Challenge and submitting photographic or video works, Participants grant to Sponsor a non-exclusive, royalty-free, license to use the photographic or video work; to join the Challenge, submissions must be received before the end of the Entry Period. Sponsor’s decisions as to the administration and operation of the Challenge and the selection of the potential winners are final and binding in all matters related to the Challenge and is not open for correspondence with Sponsor. By entering the Challenge Participants agree to abide by these Terms and Conditions.
INTELLECTUAL PROPERTY In respect of copyright and other intellectual property rights in entries and/or submissions into the Challenge, and in any and all photographs, images, artworks and other details submitted, and in the Participants involvement in the Challenge (including, all photographs, images, and video, whether the Participants appearance is featured or incidental), in all media and technology, (hereafter the “Works”) the Participants hereby grant to Sponsor and any affiliate of Sponsor, a licence to use any such copyright and other intellectual property rights in any media and in any form to the extent Sponsor deems it appropriate. Participants represent and warrant that the Challenge entry and/or submission and Works are his/her own creation and that the Works do not include nor infringe any third party intellectual property rights, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening, and that Sponsor is free and able to use the Works and artworks. Participants agree to waive any moral rights in the Works and represent and warrant that they have obtained a waiver of all applicable moral rights in the Works and further have obtained all consents and permissions in respect of the Works if applicable. Participants must ensure, and represent and warrant that any person or persons whose image has been used in the relevant Works has given consent for the use of their image or has waived any rights they may have in the images, videos or other media submitted. Failure to adequately demonstrate this consent to the satisfaction of Sponsor may result in your disqualification from the Challenge and forfeiture of any Prize.
WINNERS Each day during the entry period, one (1) submission will be randomly picked from all qualifying submissions received via the form that day, for the £25 John Lewis voucher. At the end of the Challenge, all submissions will be judged by a committee of third-party judges selected by Sponsor, and one (1) submission will be chosen for the grand prize of a Barbour jacket from the Barbour by Land Rover Range (subject to availability, an alternative may be substituted) and a Land Rover Experience (see T&Cs below) based on the following judging criteria: (a) creativity (60%) in depicting the theme of cold-weather family outdoor adventures via subject matter and creative photography; and (b) originality (40%) in addressing the theme in a novel way.
NOTIFICATION The potential winners will be notified by Instagram message or by e-mail (obtained via the entry form) and requested to confirm such other information as may be deemed necessary. If a potential winner does not respond to the message or email within Twenty Four (24) hours from when the message is posted or email sent, and/or does not meet the eligibility requirements, the potential winner will be disqualified and an alternate potential Winner may be selected, in Sponsor’s sole discretion, from among the remaining applicable eligible submissions received. In addition, Sponsor reserves the right to select an alternate winner in the event that any potential winner fails to comply with these Terms and Conditions.
WINNERS’ ANNOUNCEMENT Winners will be announced before 30th January 2015 on the Challenge post featured on the BritMums site. The announcement date may be delayed due to unexpected circumstances.
PRIZES The daily winners will each receive one (1) John Lewis gift card, with a retail value of £25 (subject to any gift card rules or restrictions). The grand prize winner will receive a Barbour jacket from the Barbour by Land Rover Range (subject to availability, an alternative may be substituted) and a Land Rover Experience (see T&Cs below).
RELEASE Participant agrees to a complete release of Instagram. Sponsor shall not be liable for: (a) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate entries and/or submissions, (b) computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays; (c) data corruption, destruction, unauthorized access to or alteration of entry and/or submission or other materials; (d) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of the prizes, or from participation in this Challenge; or (e) any printing, typographical, administrative or technological errors in any materials associated with this Challenge. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Challenge, and reserves the right, in its sole discretion, to cancel, modify or suspend this Challenge should a virus, bug, computer problem, unauthorized intervention or other causes beyond the Organizer’s control, corrupt the administration, security or proper play of this Challenge. By participating in this Challenge, Participants agree that no claim shall be asserted against Sponsor, its affiliates or any of its respective directors, officers, employees or agents in respect of any damages, rights, claims or actions of any kind whatsoever that result from their participation to this Challenge and/or acceptance and enjoyment of the prizes. The Challenge is void where prohibited. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Challenge are hereby excluded and any Participant expressly waives any and all such rights.
MISCELLANEOUS Participants accept that:
1. At the time of entry and/or submission, Participants are deemed to have read, understood and be in agreement with the Terms and Conditions of the Challenge. If they do not agree with them, they should not proceed with the Challenge. By continuing to participate in this Challenge, they agree to be bound by these Terms and Conditions.
2. Participants may not use the Challenge for the expression of political or religious ideas, pornography, obscenity, vulgarity, hatred, bigotry, racism or gratuitous violence or extreme danger.
3. Sponsor has the right to refuse any entry which contains material which is offensive, injurious, obscene, vindictive, indecent, immoral, aggressive, sexually oriented, racist, derisive, slanderous, discriminatory, extreme danger or in any other way no in line with good taste and decency, or which Sponsor deems in its sole discretion to be otherwise unacceptable.
4. Entries may not conflict with applicable law or regulations, or the rights of third parties, including without limitation featuring people who have not consented to their image being entered and featuring copy right protected works or names, logos and registered trademarks without the rights holders consent.
5. Entries may not in any way harm Sponsor, its affiliates, its agents and/or the Land Rover brand.
6. Participants may not upload, or post, any material that contains software viruses or any other computer codes, files, or programs designed to interrupt, destroy or limit the use of any software or devices.
7. Sponsor retains the right to exclude Participants from participating in the Challenge and to delete their entries if these are not in line with these Terms and Conditions.
8. The winners may be required to provide a written acknowledgement of acceptance of all Terms and Conditions of the Challenge.
FORCE MAJEURE If for any reason any aspect of this Challenge is not capable of running as planned, including by reason of infection by computer virus, telephone network failure, bugs, tampering, unauthorized intervention, fraud technical failures or any cause beyond the control of Sponsor, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Challenge, or invalidate any affected entries if required.
JURISDICTION These Terms and Conditions shall be interpreted and construed in accordance with the laws of England and Wales and the parties to these Terms and Conditions shall submit to the exclusive jurisdiction of the English Courts.

Land Rover Experience Prize T&Cs

This promotion is for a chance to win a complimentary half-day, off-road and on-road adventure for yourself and two guests at the Land Rover Experience centre of your choice, subject to availability.

There will be a safety briefing and short instructor demonstration prior to the drive.
Occupant height restrictions (1.5m minimum) apply. Occupants must be able to use standard seat belts safely, in accordance with UK laws. (The centres are equipped with approved Land Rover Accessories child seats which are subject to availability.)
All drivers must be over 23 years old and have held a full current driving licence for a minimum of three years and have no more than six penalty points.
Each winner and accompanying guest will be required to confirm their health and fitness to participate in off-road driving on the day of the adventure. A disclaimer form must be signed by all parties.
The Experience cannot be exchanged for money or goods.
Each winner and their guest will be accompanied at all times.
Each winner and their guest will be responsible for arranging their own transport to and from the Experience centre.
Land Rover reserves the right to cancel bookings due to unforeseen operational issues or factors beyond its reasonable control.
In addition to these terms and conditions, winners and their guests shall be subject to any additional Land Rover Experience terms and conditions.
Land Rover will use any information collected about you to inform you about new products and services and to improve how they serve you.
Your data will be treated in accordance with the Data Protection Act.
Your information will only be disclosed to Land Rover, its affiliated or associated companies, agencies, dealers or companies providing services for your benefit.
Guests should bring stout footwear and a big appetite for adventure.
